Consumer Health Data Privacy Policy

This Consumer Health Data Privacy (“Policy”) applies to users of our Services in Washington and Nevada and supplements Cancer Checkpoint, LLC’s (“Cancer Checkpoint” or “we”, “us”, or “our”) main Privacy Policy (https://cancercheckpoint.com/privacy-policy) to describe how we process consumer health data collected through our websites, social media accounts, mobile applications, and other online interactions and communications such as email (collectively, our “Services”).

1. Collection and Use

Consumer health data is personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status, such as: (i) individual health conditions, treatment, diseases, or diagnosis; (ii) social, psychological, behavioral, or medical interventions; (iii) health-related surgeries or procedures; (iv) use or purchase of prescribed medication; (v) bodily functions, vital signs, symptoms, or measurements of the same; (vi) diagnoses or diagnostic testing, treatment, or medication; (vii) information relating to gender affirming care; (viii) reproductive or sexual health information; (ix) biometric data; (x) genetic data; (xi) data that identifies a consumer seeking health care services or status; or (xii) information used to associate or identify a consumer with the information described in (i) - (viii) above that is derived or extrapolated from non-health information.

We may collect and use your consumer health data with your explicit consent or as reasonably necessary to provide Services that you have requested. This may include (1) using your consumer health data to monitor the cancer screenings you have planned, scheduled, or completed; (2) deidentifying the consumer health data to compile usage statistics to share with your employer if your use of the Services is in conjunction with an employer program; (3) providing, customizing, or improving Services offered to you, (4) complying with applicable legal, regulatory or professional requirements, and (5) protecting our rights or property and that of our users.

2. Data Sources

We may collect consumer health data directly from you.

3. Data Sharing

We do not sell your personal information, including your consumer health data. We may engage service providers to process your data, including consumer health data, to help operate our Services, facilitate communication with you, provide the products and Services you request, and perform other app-related tasks. This may include sharing consumer health data with service providers for cloud hosting, email delivery, push notification, and analytics services. We may also disclose your consumer health data: (1) if you use the Care Circle feature, (2) if deidentified, to your employer if your use of the services is under the employer’s enrollment in our Services, (3) in the sale of our business, and (4) for compliance with laws and law enforcement.

4. Your Rights

Consumers in Washington and Nevada have specific rights related to their consumer health data, including the right to:

  • request confirmation that we collect or share your consumer health data;
  • request access to your consumer health data that we have collected or control, including:
    • a list of all third parties and affiliates that we have shared your consumer health data with; and
    • the email addresses or other online methods to contact those third parties and affiliates;
  • withdraw your consent for our collection and sharing of your consumer health data. If you withdraw your consent to process consumer health data, we will be unable to provide our Services;
  • request that we delete your consumer health data;
  • be free from discriminatory treatment for exercising any of your privacy rights; and
  • if we deny your rights-related request, you have the right to appeal the decision by contacting us at privacy@cancercheckpoint.com.

5. Verification of Requests

For certain consumer health data requests, we must first verify your identity before processing your request. To do so, we may ask you to provide us with your full name and contact information. Depending on your request, we may ask you to provide additional information. Once we receive this information, we will then review it and determine whether we are able to match it to the information we maintain about you to verify your identity.

6. Changes to This Policy

We may modify or amend this Policy from time to time at our discretion. When we make changes to this Policy, we will amend the revision date at the top of this page and such modified or amended Policy shall be effective as to you and your consumer health data as of that revision date. We encourage you to periodically review this Policy to view any updates.
